Existing law permits rent&lt;br&gt;control in mobilehome parks. Existing law exempts certain rental&lt;br&gt;agreements relating to mobilehomes from any local measure&lt;br&gt;establishing the maximum amount that a landlord may charge a tenant&lt;br&gt;for rent.&lt;br&gt;This bill would provide, in addition, that upon the sale,&lt;br&gt;assignment, transfer, or termination of an interest in a mobilehome&lt;br&gt;or a mobilehome tenancy in a mobilehome park, the management of the&lt;br&gt;park may offer a new rental agreement containing an initial rent &lt;em&gt;&lt;br&gt;that is the lesser of an &lt;/em&gt;&lt;em&gt;amount &lt;/em&gt;in excess of the&lt;br&gt;maximum rent established by a local measure by specified percentages,&lt;br&gt;which would increase &lt;strike&gt;over the next 5 years &lt;/strike&gt;&lt;em&gt;,&lt;br&gt;beginning January 1, 2011, &lt;/em&gt;up to 100% of the last-charged rent&lt;br&gt;&lt;em&gt;, or market levels, as specified &lt;/em&gt;. The bill would except&lt;br&gt;certain mobilehome parks from its provisions, including those that&lt;br&gt;have common facilities that have been cited as health and safety&lt;br&gt;risks that remain unabated for 6 months or longer. The bill would&lt;br&gt;provide that, after an increase in initial rent, the rent should be&lt;br&gt;governed by the local measure. City of Goleta, &lt;/strong&gt;&lt;/em&gt;which found that Goleta's Mobilehome Rent Ordinance constitutes a regulatory &amp;quot;taking&amp;quot; of property under the United States Constitution for which just compensation must be paid. The decision sent shockwaves throughout cities and counties which either have or are contemplating a rent ordinance, as well as mobilehome resident organizations throughout California. If left to stand, the ruling could provide a means for park owners everywhere to bring new challenges to rent ordinances, and could discourage jurisdictions now considering an ordinance from adopting their own protections. <description>&amp;nbsp;pdate&lt;br&gt;&amp;nbsp;July 7, 2009 &lt;br&gt;AB 566 passed out of Senate Trans and Housing on a 7 to 3 vote: one vote extra this hearing instead of one vote short last hearing. &amp;nbsp; &amp;nbsp; Senator Simitian, who had been elusive about his vote on the bill, was&amp;nbsp; extremely instrumental in helping the bill move forward.&amp;nbsp; The Senator&amp;nbsp; repeatedly reminded the committee what the bill actually would do, thereby clearing the confusion that the MHP lobbyists continued to create during the long hearing.&amp;nbsp; On the first vote&amp;nbsp; Senators Lowenthal, Kehoe, Pavley, Simitian and Wolk voted &amp;quot;aye&amp;quot;. Two hours later both Senators Oropeza and DeSaulnier added their &amp;quot;aye&amp;quot; votes, giving us a 7-vote victory.&lt;br&gt;&lt;br&gt;AB 566 now moves to the Senate Appropriations Committee which may or may not meet in the next couple of weeks.&amp;nbsp; If the Legislature agrees to a revised budget , then they will recess 7/17 and return 8/17.&amp;nbsp; We will check with the Senate Appropriations Committee in the next couple&amp;nbsp; of days to determine whether will send it to their Suspense file or conduct a hearing.&amp;nbsp; It appears much more likely that it will go to the Suspense file where it will remain until the Legislature returns in August.&lt;br&gt;&lt;br&gt;We will be in touch with you as soon as anything occurs.&amp;nbsp; When AB 566 is sent to the Senate floor, we&amp;nbsp; will immediately alert you that your cards, letters, calls, local legislative visits should commence.&lt;br&gt;&lt;br&gt;Great day in Sacramento!!
